ABOUT US
RISING RAYS DIGITAL LLP, through its digital platform “JOKERR.App”, is a premium video-on-demand platform bringing you amazing horizontal series, long-form episodic shows, movies, and premium audio-visual content anywhere and anytime (hereinafter referred to as “We”, “Us”, or “Jokerr App”).
The application operates strictly as a premium, subscription-only service tailored for diverse audiences with varying preferences across numerous genres, including horror, drama, thriller, action, comedy, and more.
TERMS AND CONDITIONS
User Agreement
RISING RAYS DIGITAL LLP, having its registered office at New Room No. 1045, Adarsh Nagar, New Link Road, Jogeshwari West, Mumbai, Maharashtra - 400102, owns and operates the “Over The Top” (OTT) on-demand digital application and services under the brand name 'Jokerr.App'.
This user agreement (“User Agreement”) shall be read in conjunction with our Privacy Policy, forming an integral part of the legal contract between Jokerr.App and you (“User”, “You”, or “Your”). Your access to the Services, including the activation of our Subscription Services, constitutes your unconditional agreement to be bound by these terms. This document is an “electronic record” generated by a computer system under the Information Technology Act, 2000, and does not require physical or digital signatures.
We reserve the right to modify, update, or revise this User Agreement at any time without prior individual notice. Your continued use of the app post-updates constitutes acceptance of the revised terms.
1. Terms of Use
This agreement governs your access to all features, branding, data, text, images, and audio-visual content (horizontal series, shows, movies, etc.) on the Jokerr.App.
Age Restricton: The Service is available only to Users who have attained the age of majority (18 years and above). Minors are strictly prohibited from creating accounts or purchasing subscriptions.
Third-Party Integrations: The use of third-party APIs (such as YouTube or specific native media players) within our products implies your agreement to comply with their respective Terms of Service as well.
2. Service Usage & Evolution
You may use the Services only if you can form a binding contract with Rising Rays Digital LLP under applicable laws. The architecture, library, and functionality of our Services are constantly evolving. We reserve the right to modify, remove, swap, or temporarily suspend any aspect, show, or feature of the platform at our sole discretion without prior notice or liability.
3. Premium Subscription Model
The Jokerr App does not offer any free tiers, trial packs, or complimentary evaluation periods. Access to the platform's media library requires the direct purchase and activation of a paid Subscription plan.
Account Creation: To become a subscriber, you must create an Account using a verified mobile number or verified social media credentials. You agree to provide accurate, current, and complete details and to prevent unauthorized profile spoofing or account sharing.
Subscription Term: Access operates strictly on a Monthly Pack renewal cycle. The applicable subscription fee is inclusive of statutory taxes and must be processed through our approved third-party Payment Methods.
Billing & Auto-Renewal: Your monthly subscription fee will be charged to your chosen Payment Method on the specific calendar day corresponding to the commencement of your subscription. Subscriptions auto-renew at the end of each monthly cycle unless cancelled by you prior to the billing date through your profile settings.
4. Zero-Refund & Cancellation Policy
As Jokerr.App provides non-tangible, irrevocable digital goods via instantaneous streaming access, all purchases are final, and we do not issue refunds or pro-rata credits once a monthly pack is activated.
Cancellation: You may cancel your subscription at any time. Upon cancellation, your access will continue uninterrupted until the end of your current monthly billing cycle, after which your account will be restricted from content playback.
Exceptional Circumstances: Refunds will only be evaluated and processed in verified cases of accidental duplicate billing caused by payment gateway loops, or severe technical failures originating strictly from our servers that systematically prevent content access for more than 48 consecutive hours. Such instances remain subject to validation by our payment gateway partners.
5. Third-Party Content & Gateways
In addition to original Jokerr.App content, we may host Third-Party Content or promotional partner markers on an "as is" basis. Rising Rays Digital LLP acts purely as an "Intermediary" under the Information Technology Act, 2000, and holds no liability regarding intellectual property or defamation claims tied to third-party assets.
Furthermore, we do not collect, process, or store sensitive financial data like credit card numbers, CVVs, or OTPs. All financial transactions are securely handled by third-party PCI-DSS compliant gateways (e.g., Zwitch, Razorpay, or App Stores). Rising Rays Digital LLP disclaims all liability for losses incurred due to third-party banking errors, network drops, or gateway frauds.
6. Intellectual Property & Cross-Platform Rights
All patents, trademarks, copyrights, trade secrets, software code, and exclusive distribution rights associated with the horizontal series, movies, and interface layout of the Jokerr App are owned strictly by Rising Rays Digital LLP or its legitimate licensors.
Limited License: You are granted a personal, non-exclusive, non-transferable, revocable license to view content for personal, non-commercial entertainment purposes only. You shall not copy, deep-link, frame, capture, reverse-engineer, or commercially exploit any asset.
Cross-Platform Rights: The Company retains the absolute right, at its sole discretion, to distribute, sync, or make the same or substantially similar content available on other digital platforms, sister applications, or alternative services owned, operated, or controlled by Rising Rays Digital LLP now or in the future, without additional notice, compensation, or liability to existing users.
7. Core Conditions and User Restrictions
You expressly agree not to engage in, facilitate, or encourage any of the following prohibited behaviors:
Security Tampering: Attempting to probe, scan, or test the vulnerability of our application, servers, or non-public system environments.
Geo-Filtering Bypass: Circumventing geographical licensing boundaries or territorial controls through the use of Virtual Private Networks (VPNs), proxies, location-spoofing tools, or network emulators.
Automated Extraction: Launching any automated script, scraper, bot, or data-mining tool to index, cache, download, or crawl the platform.
AI Model Training: Using any content, audio, text, or visual frames from the Jokerr App for the purpose of prompting, fine-tuning, training, testing, benchmarking, or validating any machine learning tools, artificial intelligence (AI) models, or competitive automated systems.
8. Monitoring for Suspicious Activity & Anti-Piracy
We reserve the right to deploy monitoring scripts, track technical device signals, and analyze usage patterns to isolate fraudulent, abusive, or pirated activity. This includes detecting access via unauthorized or modified application packages (cloned apps/cracked APKs), screen-recording hooks, or abnormal multi-device streaming patterns on a single profile.
If we determine, at our absolute discretion, that you have violated these restrictions or attempted stream-ripping, we will immediately suspend or permanently terminate your access without prior notice. In such cases, all internal balances are forfeited, and no refunds or compensations will be issued.
9. User Consent for Communications
By registering an account and maintaining an active paid subscription, you expressly consent to receive essential transactional notifications, system alerts, operational updates, and promotional content detailing new show releases, offers, and premium campaigns.
These communications may be delivered to your registered mobile number and email address via WhatsApp, SMS, automated voice calls, and Rich Communication Services (RCS) from Jokerr App and our verified marketing partners. You may opt out of marketing-specific alerts at any time by writing to support@jokerr.app.
10. Indemnity
You agree to defend, indemnify, and hold harmless Rising Rays Digital LLP, its parent entities, partners, employees, and designated directors (including Karan Bharti and Monu Yadav) from and against any third-party claims, liabilities, legal fees, damages, or financial losses resulting from your breach of this User Agreement, misuse of the app, or violation of any intellectual property rights.
11. Copyright Infringement Policy (DMCA/Indian Copyright Act)
If you are a copyright owner or an authorized agent and believe that any media hosted on the Jokerr App infringes upon your copyright, you may submit a formal written notice to our Grievance Officer. Your notice must contain:
Clear identification of the copyrighted work claimed to have been infringed.
The specific location/URL within the Jokerr App where the material resides.
Your verified physical address, telephone number, and email.
A signed statement under penalty of perjury that the information provided is accurate and that you are the bona fide owner or authorized representative.
12. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RISING RAYS DIGITAL LLP DISCLAIMS ALL WARRANTIES REGARDING PLATFORM ACCURACY, UNINTERRUPTED UPTIME, DATA SECURITY, OR THE CONTINUOUS AVAILABILITY OF SPECIFIC TITLES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUES, OR DATA ARISING OUT OF YOUR USE OF OR INABILITY TO ACCESS THE APP.
13. Controlling Law and Jurisdiction
This User Agreement, privacy framework, and platform rules shall be governed by and construed exclusively in accordance with the substantive laws of India. All disputes, contentions, or legal claims arising out of the use of this service shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, India.
